House Rent Agreement


RESIDENTIAL LEASE AGREEMENT

This Agreement is made between [Full name and address of landlord] ("Landlord") and [Full name and address of Tenant] ("Tenant"). In consideration of the mutual promises, and for good and valuable consideration, Landlord and Tenant agree as follows:

Terms
1.
Description of Premises. Landlord leases to Tenant, and Tenant leases from Landlord, the property described in this Agreement for the term and in accordance with the conditions of this lease. The real estate is located at the following address: ______________________________________________ and is described as follows:
_________________________________________________________ ("Premises").


2.

Term. The term shall be for the period commencing on [date] and ending on [date].

Rent; Security. The rent for the term is tk.___________, payable in advance without any demand or notice, deduction, set-off, or recoupment, in equal monthly installments of tk.________. Monthly installments shall be paid by check payable to the Landlord on the first day of each month during the term (the "Rent Due Date"). Landlord acknowledges receipt from Tenant of the sum of tk.______ as security deposit. This deposit ____________ [insert either: shall or shall not] bear interest and __________ [insert either: may or may not] be commingled with Landlord's other funds. The security deposit shall be returned to Tenant within _____ days of the termination of the full term of this lease and surrender of possession, less the cost of any repairs that are made necessary by Tenant's actions. If Tenant fails to pay rent within days after the Rent Due Date, Tenant shall pay, as a late charge, a sum equal to percent (%) of the amount delinquent in rent.

Tenant's Occupancy and Use. The Premises shall be used solely as a residential dwelling for Tenant and Tenant's immediate family. Tenant agrees to promptly pay all charges for________ [insert items, such as telephone, gas, electricity, sewage, and water] incurred by Tenant's use of the Premises. Tenant shall not use or permit the use of the Premises in such a way as to violate any applicable laws rules or regulations. Tenant will promptly advise Landlord of any situation or condition that requires repair or maintenance. Tenant will not make any renovation or modification, including decorative improvements such as painting or paneling, in the Premises without first obtaining Landlord's approval, or Landlord may require Tenant to remove any or all of such additions, improvements or fixtures. Tenant will permit Landlord to regularly enter the Premises during normal working hours for the purpose of maintaining or making repairs or alterations to the building. Upon termination of this Lease, or upon request of Landlord, Tenant will return all furniture and personal property provided to Tenant by Landlord in the same condition that it was received by Tenant (less reasonable wear and tear).

Transfer of Tenancy; Insurance. Tenant will not assign this Agreement or sublease the Premises without the express written consent of Landlord, and in the event of such consent this Agreement shall be binding upon and inure to the benefit of the heirs, personal representatives, and permitted assigns or subtenants. Tenant will carry and maintain in full force and effect during the term of this Lease and any lease extension or renewal, at Tenant's expense, the following insurance coverage with respect to the Premises and the personal property on the Premises: liability insurance coverage of at least million dollars for death or injury to any one person, million dollars per occurrence for death or bodily injury, and million dollars for property damage liability. Tenant shall carry such fire and extended coverage insurance upon its personal property as Tenant deems appropriate, and shall not look to Landlord to insure Tenant's personal property. The insurance shall be for the benefit of both Landlord and Tenant as protection against all liability claims arising from the Premises, causing Landlord to be named as an additional-named insured on such policies of insurance.

Landlord's Covenants. Landlord agrees (1) to maintain the Premises in condition fit for their intended use and to make all necessary repairs of which Landlord is aware, including providing adequate heat and water, and a sound physical structure; (2) to maintain the grounds and remove the rubbish; [If Premises is rented furnished add "and (3) to provide, at Landlord's sole discretion, the use of certain furniture and personal property placed by Landlord in the Premises during the course of this Lease for the benefit of Tenant. Landlord shall furnish an itemized inventory of any furniture and personal property provided to Tenant. "]

Covenants of Both Landlord and Tenant. Landlord and Tenant agree that:

Breach and Remedies.

Quiet Possession. Landlord and its agents shall not interfere with Tenant's right of quiet and peaceful enjoyment.

Delivery of Possession. If Landlord shall be unable for any reason to deliver possession of the Premises on the commencement date of the term, Landlord shall not be liable to Tenant for any damage caused thereby, nor shall this lease become void or voidable, nor shall the lease term in any way be extended, In such event Tenant shall not be liable for any rent until Landlord delivers possession. If possession is delayed for ____ days, Tenant may terminate this lease.


11.

Surrender. At the end of the lease term, or termination of this lease, all buildings, fixtures and structures on these Premises shall become the property of Landlord. Tenant shall then promptly surrender and deliver up the Premises in good condition, damages from normal wear and tear excepted.


12.

Holding Over. Holding over by Tenant after the expiration of this Lease, or any lease renewal or extension, whether with or without the consent of Landlord, shall not operate to extend or renew this Lease; and any such holding over shall be construed as a tenancy from month to month at the monthly rental which shall have been payable at the time immediately prior to when such holding over shall have commenced; and such tenancy shall be subject to all the terms, conditions, covenants and agreements of this Lease.


13.

Indemnification. Tenant agrees to hold Landlord, its governing board, officers, agents and employees harmless for any liability for utility payments or other expenses or damages, and harmless from any claim, suit, or proceeding arising out of this Lease or Tenant's use of the Premises, including indemnifying Landlord for reasonable expenses incurred in defending such claims.


14.

Destruction. If at any time during the lease term, or any extension or renewal, the Premises shall be totally or partially destroyed by fire, earthquake, or other calamity, then Landlord shall have the option to rebuild or repair the same in as good condition as they were before the calamity. Landlord shall send written notice of this intent to Tenant within ____ days after the calamity. In such case, a just and proportionate part of the rental specified in this Agreement shall be abated until the Premises have been rebuilt and repaired. In case, however, Landlord elects not to rebuild or repair said Premises, or such repairs are not completed within ___ days, Tenant or Landlord may, upon ___ days written notice, terminate the lease and rent shall only be payable up to the time of the calamity. In the event of termination, Tenant shall have a reasonable period of time to vacate the Premises.


15.

Entire Agreement and Modification. This Agreement constitutes the entire  understanding between the parties with respect to its subject matter and supersedes any and all prior understandings and agreements, oral and written, relating to the subject matter. Any Agreement amendment must be in writing signed by an authorized representative of both parties.


16.

Force Majeure. Neither Landlord nor Tenant shall be required to perform any term, condition, or covenant in this lease so long as such performance is delayed or prevented by any acts of God, strikes, lockouts, material or labor restrictions, by any government authority, civil riot, floods, and any similar cause not reasonably within the control of Landlord or Tenant and which by the exercise of due diligence Landlord or Tenant is unable, wholly or in part, to prevent or overcome.

Notice. Any notice to either party must be in writing signed by the party giving it, and shall be delivered either personally or by registered or certified mail addressed as follows:

Governing Law; Forum. This Agreement shall be governed by and construed under the laws of the State of , which shall be the forum for any lawsuit arising from or incident to this Agreement.


19.

Severability. The terms of this Agreement are severable. If any term or provision is declared by a court of competent jurisdiction to be illegal, void, or unenforceable, the remainder of the provisions shall continue to be valid and enforceable.


20.

Non-Waiver. The failure of either party to exercise any of its rights under this Agreement for a breach shall not be deemed to be a waiver of rights, nor shall it be deemed to be a waiver of any subsequent breach, either of the same provision or otherwise.

House Rent Legislation: Some issues
The fixed income city dwellers comprising both middle and lower middle class households are in real trouble to tackle the rising house rent in Dhaka city. Most landlords, in the recent years, have increased their rentals in the excuse of increase in price of the essential commodities, construction materials, holding tax and cost of the utility services.
Bangladesh has almost become a city state with Dhaka as its capital, in which the house rent has increased nearly 285 per cent during the last 18 years, according to a survey conducted by the Consumers' Association of Bangladesh (CAB). A jump over 23 per cent in house rent was witnessed in 1991 and the trend continued later on. It was increased by 17.4 per cent in 2001, 13.49 per cent in 2002, 8.4 per cent in 2003, 9.96 per cent in 2004, 7.89 per cent in 2005 and 14.14 per cent in 2006. Further it has increased average by 21.48 per cent only in 2007. Separately in the same year, 21.68 per cent has increased for building accommodation, 18.57 per cent for semi-building accommodation, 23.33 per cent for tin shed hut, 26.98 per cent for mess accommodation and 16.88 per cent for slum dwellings. On an average, nearly 50 per cent of monthly income of a household is spent on house rent. However, ideally it should not exceed 20 per cent of income of any household.
The high influx of population for the purpose of employment in Dhaka city has created the disparity between demand and supply, which has in fact caused increase in house rent. There is no specific statistics for Dhaka city regarding total number of landlords as well as tenants. But there are around 0.2 million holdings located in Dhaka City Corporation (DCC) area. Almost 90 per cent of about 15 million people in Dhaka city make their living on tenancy. The growing influx of people has resulted in an opportunity to the landlords to increase the house rent due to shortage of houses. The prerogative enjoyed by the landlords due to lack of legislative provision also allows them to develop a cartel to increase house rent.
The fixed and low income households are the worst sufferer affected by the frequent increase in house rent. But there is no control of house rent in absence of effective government measures. There is absolutely no authority to monitor the growth of house rent. Also there is no effective law to protect the rights of the tenants. In the website of DCC, monthly house rent rate of 10 different zones are shown, but these are not implemented on ground.
Rent Controller system was first introduced in this subcontinent during British rule. Rent Control Act was enacted for the first time in 1943. It was amended in 1953 in the then East Bengal of united Pakistan. As a continuation to this, the latest amendment was made back in 1991, which is known as Premises Rent Control Act 1991. There are total 36 sections in this act.
As per the law, house rent should be assessed at 15 per cent of the total cost of land and construction for a premise, which is in fact ignored in most of the cases. The law also says that the landlord cannot increase the rent unless the house has been remodeled or renovated. Increase of house rent should not be based on only cost of land and construction of house, but should also include the depreciation value of the house. It should be determined on the basis of location, space, amenities and present market price; and also separately for commercial and residential areas.
In India, house rent is charged based on standard provision devised by the local authority. In Delhi it is to be maximum 10 per cent of construction cost and market price of land based on historical values, not as per current market value. There rent also decreases according to the life of property. In Pakistan it is practiced as per mutual agreement of both landlords and tenants at the interval of every three years of tenancy. In the USA, the Neighborhood Councils settle any dispute related to house rent between landlords and tenants following the process of alternative dispute resolution (ADR). Those Councils act as innovative forums for all community stakeholders as quasi city entities that affect the lives of the citizen.
The existing laws related to house rent contain lot of inconsistencies in terms of implementations. Both landlords and tenants are ignorant about the law in general. The law is biased towards the landlords in particular. The tenants are vulnerable to various exploitations made by the landlords in absence of effective rent control mechanism. There is no effective body to protect the rights of the tenants. Landlords in Dhaka city increase house rent at certain interval. There is no specific law as to when and to what extent it can be increased. Any rent related case is to be finalized within three months in the Court of Rent Controller, but it does not happen as such. In practice the Assistant Judges of any area are appointed as ex-officio Rent Controller.
The law also mandates both landlords and tenants to sign a written house rent agreement. But many landlords do not comply with such provision. Some of them, among those who comply, do not provide original deed of agreement for tenancy to the tenants; instead they are provided with a photocopy. The tenants can not avail any legal protection from any court of law in absence of original deed agreement as such photocopy is not accepted in the court. Many landlords do not provide appropriate money receipt upon receipt of rent. Few do not provide original utility bills, rather sometime avail undue advantages to impose personal consumption of utilities on to the tenants. Some even do not repair the fittings on nonfunctioning and perform periodical maintenance.
Most landlords demand a substantial amount of advance money as security deposit from the tenants before renting off a house. But legal provision allows only receiving rent of one month in advance. Even after paying such advance, if in any case the tenant fails to pay one month rent in time within seven days of the scheduled date, the court declares the tenant as rent defaulter and passes order to pay the rent within next 15 days. If it is not paid, then the court asks the law enforcing agency to take appropriate action so that the tenant vacate the house. In case the rent seems to be more to the tenant, the court will entertain this complaint only within six months of occupying the house.
House rent is to be made part of Consumers' Protection Act. House constructed for residential purpose should not be allowed to rent for commercial purpose. The tenants must be legally empowered and their rights are specifically mentioned and ensured. There must be a strong regulatory body to monitor the affairs related to house rent. An effective system must be developed immediately to solve the problem of mass people. There must be a comprehensive system in determining house rent, in which both landlords and tenants will find themselves in a win-win situation.

সংসদ কর্তৃক গৃহীত নিম্নলিখিত আইনটি ২৩ শে অগ্রহায়ণ,১৪১১/ ৭ ই ডিসেম্বর,২০০৪ তারিখে রাষ্ট্রপতির সম্মতিলাভ করিয়াছে এবং এতদ্বারা এই আইনটি সর্বসাধারণের অবগতির জন্য প্রকাশ করা যাইতেছে :-

জন্ম ও মৃত্যু নিবন্ধন আইন সংশোধন ও সংহতকরণকল্পে প্রণীত আইন
যেহেতু জন্ম ও মৃত্যু নিবন্ধন সংক্রান্ত বিষয়ে প্রচলিত আইনের সংশোধন ও সংহতকরণ সমীচীন ও প্রয়োজনীয়;
সেহেতু এতদ্বারা নিম্নরূপ আইন প্রণয়ন করা হইল:-

অধ্যায়-১
প্রারম্ভিক
১। সংক্ষিপ্ত শিরোনাম ও প্রবর্তন ।-
(১)
এই আইন জন্ম ও মৃত্যু নিবন্ধন আইন,২০০৪ নামে অভিহিত হইবে ।
(২)
সরকার, সরকারী গেজেটে প্রজ্ঞাপন দ্বারা, যেই তারিখ নির্ধারণ করিবে সেই তারিখে এই আইন কার্যকর হইবে ।
২ । সংজ্ঞা ।- বিষয় বা প্রসংগের পরিপন্থী না হইলে ,এই আইনে ---
(ক)
'' অভিভাবক'' অর্থ The Guardians and Wards Act,1989 (Act VIII of 1980) এ সংজ্ঞায়িত অভিভাবক;
(খ)
'' ইউনিয়ন পরিষদ'' অর্থ The Local Government (Union Parishads) Ordinance,1983 (Ordinance No. LI of 1983) এর অধীন সংজ্ঞায়িত ইউনিয়ন পরিষদ;
(গ)
" ওয়ার্ড" অর্থ সিটি করপোরেশন বা পৌরসভা বা ইউনিয়ন পরিষদের কোনো ওয়ার্ড ;
(ঘ)
"কমিশনার" অর্থ সিটি করপোরেশন বা পৌরসভার কোনো কমিশনার;
(ঙ)
"ক্যান্টনম্যান্ট" অর্থ Cantonments Act. 1924 (Act II of 1924) এর অধীন গঠিত কোন ক্যান্টনম্যান্ট;
 (চ)
"জন্ম বা মৃত্যু সনদ" অর্থ এই আইনের অধীন জন্ম বা মৃত্যু নিবন্ধন বহিতে লিপিবদ্ধ তথ্যের নিবন্ধক কর্তৃক প্রত্যায়িত অনুলিপি;
(ছ)
"জন্ম" অর্থ কোনো ব্যক্তির জীবিত ভূমিষ্ট হওয়া;
(জ)
"নির্ধারিত" অর্থ এই আইনের অধীন প্রণীত বিধি দ্বারা নির্ধারিত;
(ঝ)
"নিবন্ধক" অর্থ ধারা ৪ এর অধীন দায়িত্বপ্রাপ্ত ব্যক্তি;
(ঞ)
"নিবন্ধন" অর্থ নিবন্ধন বহিতে কোন ব্যক্তির জন্ম ও মৃত্যু নিবন্ধন করা ;
(ট)
"নিবন্ধন বহি" অর্থ কোন ব্যক্তির জন্ম ও মৃত্যুর নিবন্ধন বহি;
(ঠ)
"পৌরসভা" অর্থ Paurashava Ordinance,1977 ( Ord. No. XXVI of 1977) এর অধীন গঠিত কোনো পৌরসভা;
(ড)
"প্রশাসক" অর্থ Paurashava Ordinance,1977 ( Ord. No. XXVI of 1977) এর অধীন কোনো প্রশাসক;
(ঢ)
"ব্যক্তি" অর্থ কোন বাংলাদেশী অথবা বাংলাদেশে বসবাসকারী কোনো বিদেশী এবং বাংলাদেশে আশ্রয় গ্রহণকারী কোনো শরণার্থী ;
(ণ)
"মৃত্যু" অর্থ কোনো ব্যক্তির জীবনাবসান হওয়া;
(ত)
"সদস্য" অর্থ ইউনিয়ন পরিষদের কোনো সদস্য;
(থ)
"সরকার" অর্থ স্থানীয় সরকার বিভাগ,স্থানীয় সরকার, পল্লী উন্নয়ন ও সমবায় মন্ত্রণালয় ; এবং
(দ)
"সিটি করপোরেশন" অর্থ ঢাকা, চট্টগ্রাম,খুলনা,রাজশাহী,বরিশাল ও সিলেট সিটি করপোরেশন এবং কোনো আইনের অধীন সময়ে সময়ে গঠিত অন্য কোন সিটি করপোরেশন ।
৩ । আইনের প্রাধান্য ।- অন্য কোনো আইনে যাহা কিছুই থাকুক না কেন, এই আইন কার্যকর হইবার পর এই আইনের বিধান মোতাবেক কোনো ব্যক্তির জন্ম বা মৃত্যু নিবন্ধন করিতে হইবে ।
অধ্যায়-২
নিবন্ধক ও নিবন্ধন
৪ । নিবন্ধক ।- জন্ম ও মৃত্যু নিবন্ধনের জন্য বর্ণিত ব্যক্তিগণ নিবন্ধক হিসাবে দায়িত্ব পালন করিবেন,যথা :-
(ক) সিটি করপোরেশন এলাকায় জন্ম গ্রহণকারী, মৃত্যুবরণকারী অথবা স্থায়ীভাবে বসবাসকারী ব্যক্তিদের ক্ষেত্রে সংশ্লিষ্ট সিটি করপোরেশন মেয়র বা তত্‍কর্তৃক ক্ষমতাপ্রাপ্ত কোনো কর্মকর্তা বা কমিশনার;
(খ) পৌরসভা এলাকায় জন্ম গ্রহণকারী, মৃত্যুবরণকারী অথবা স্থায়ীভাবে বসবাসকারী ব্যক্তিদের ক্ষেত্রে সংশ্লিষ্ট পৌরসভার চেয়ারম্যান বা প্রশাসক বা তত্কর্তৃক ক্ষমতাপ্রাপ্ত অন্য কোনো কর্মকর্তা বা কমিশনার;
(গ) ইউনিয়ন পরিষদ এলাকায় জন্ম গ্রহণকারী, মৃত্যুবরণকারী অথবা স্থায়ীভাবে বসবাসকারী ব্যক্তিদের ক্ষেত্রে সংশ্লিষ্ট ইউনিয়ন পরিষদের চেয়ারম্যান বা সরকার কর্তৃক ক্ষমতাপ্রাপ্ত কোনো কর্মকর্তা বা সদস্য;
(ঘ) ক্যান্টনমেন্ট এলাকায় জন্মগ্রহণকারী, মৃত্যুবরণকারী অথবা স্থায়ীভাবে বসবাসকারী ব্যক্তিদের ক্ষেত্রে সংশ্লিষ্ট ক্যান্টনমেন্ট বোর্ডের প্রেসিডেন্ট বা তত্কর্তৃক ক্ষমতাপ্রাপ্ত কোনো কর্মকর্তা;
(ঙ) বিদেশে জন্মগ্রহণকারী ও মৃত্যুবরণকারী কোনো বাংলাদেশীর ক্ষেত্রে বাংলাদেশ দূতাবাসের রাষ্ট্রদূত বা তত্কর্তৃক ক্ষমতাপ্রাপ্ত কোনো কর্মকর্তা ৷
৫ ৷ নিবন্ধন - (১) জাতি, ধর্ম, বর্ণ, গোষ্ঠী, লিঙ্গ নির্বিশেষে নিবন্ধক সকল ব্যক্তির জন্ম ও মৃত্যু নিবন্ধন বহিতে নিবন্ধন করিবে ৷
(২) নির্দিষ্ট সময় ও নির্ধারিত পদ্ধতিতে কোনো ব্যক্তির জন্ম বা মৃত্যু নিবন্ধনের জন্য নিবন্ধকের নিকট তথ্য প্রেরণ করিতে হইবে ৷
  (৩) জন্ম ও মৃত্যু নিবন্ধনের জন্য এই ধারার অধীন তথ্য প্রদানের ক্ষেত্রে তথ্য প্রদানকারীর এই মর্মে একটি ঘোষণা থাকিবে যে, উক্ত তথ্য সঠিক এবং জন্ম বা মৃত্যু ইতিপূর্বে নিবন্ধিত হয় নাই ৷
৬ ৷ নিবন্ধকের দায়িত্ব - নিবন্ধকের নিম্নবর্ণিত দায়িত্ব থাকিবে, যথাঃ-
(ক)
সকল ব্যক্তির জন্ম ও মৃত্যু নিবন্ধন নিশ্চিত করা;
(খ)
নিবন্ধনের জন্য প্রয়োজনীয় তথ্য সংগ্রহ, এবং ফরম, রেজিস্টার ও সনদ ছাপানো অথবা সংগ্রহ;
 (গ)
নিবন্ধন সংক্রান্ত নথি পত্র বা নিবন্ধন বহি সংরক্ষণ করা;
(ঘ)
 জন্ম ও মৃত্যু সনদ সরবরাহ করা; এবং
(ঙ)
 বিধি দ্বারা নির্ধারিত অন্য কোনো দায়িত্ব ৷
৭ ৷ নিবন্ধকের ক্ষমতা- (১) কোনো ব্যক্তির নিবন্ধন করার জন্য তথ্যের সত্যতার যাচাই এর প্রয়োজনে নিবন্ধক নিজে অথবা তত্কর্তৃক ক্ষমতাপ্রাপ্ত ব্যক্তির দ্বারা তদন্ত করিতে পারিবেন ৷
(২) নির্দিষ্ট সময়ের কোনো ব্যক্তির জন্ম বা মৃত্যু নিবন্ধন করা না হইলে নিবন্ধক সংশ্লিষ্ট ব্যক্তির পিতা মাতা বা পুত্র বা কন্যা বা অভিভাবক অথবা নির্ধারিত কোনো ব্যক্তিকে জন্ম ও মৃত্যুর তথ্য প্রদানের নির্দেশ সম্বলিত নোটিশ জারী করিতে পারিবেন ৷ 
(৩) উপ-ধারা (১) এর অধীন তদন্তের স্বার্থে নিবন্ধক বা তত্কর্তৃক ক্ষমতাপ্রাপ্ত ব্যক্তি নিবন্ধন বহি তলব করিতে এবং প্রয়োজনে কোনো ব্যক্তিকে সাক্ষ্য প্রদানের নোটিশ দিতে পারিবেন ৷
৮ ৷ জন্ম ও মৃত্যু তথ্য প্রদানের জন্য দায়ী ব্যক্তি - (১) শিশুর পিতা বা মাতা বা অভিভাবক বা নির্ধারিত ব্যক্তি উক্ত শিশুর জন্মের ৪৫ (পঁয়তাল্লিশ) দিনের মধ্যে জন্ম সংক্রান্ত তথ্য নিবন্ধকের নিকট প্রদানের জন্য বাধ্য থাকিবেন ৷
(২) মৃত ব্যক্তির পুত্র বা কন্যা বা অভিভাবক বা নির্ধারিত ব্যক্তি মৃত্যুর ৩০ (ত্রিশ) দিনের মধ্যে মৃত্যু সংক্রান্ত তথ্য নিবন্ধকের নিকট প্রদানের জন্য বাধ্য থাকিবেন ৷
৯ ৷ কতিপয় কর্মকর্তা বা কর্মচারীর দায়িত্ব - (১) নিম্নবর্ণিত ব্যক্তিগণ কোনো ব্যক্তির জন্ম বা মৃত্যু নিবন্ধনের জন্য নিবন্ধকের নিকট তথ্য প্রেরণ করিতে পারিবেন, যথাঃ-
(ক)
ইউনিয়ন পরিষদের সদস্য, এবং সচিব;
(খ)
গ্রাম পুলিশ;
(গ)
সিটি করপোরেশন বা পৌরসভার কমিশনার;
(ঘ)
ইউনিয়ন পরিষদ, পৌরসভা, সিটি করপোরেশন অথবা ক্যান্টনমেন্ট এলাকায় নিয়োজিত স্বাস্থ্যকর্মী ও পরিবার কল্যাণ কর্মী;
(ঙ)
স্বাস্থ্য ও পরিবার কল্যাণ সেক্টরে নিয়োজিত বেসরকারী প্রতিষ্ঠানের (এনজিও) মাঠকর্মী;
(চ)
কোনো সরকারী বা বেসরকারী হাসপাতাল বা ক্লিনিক বা মাতৃসদন বা অন্য কোনো প্রতিষ্ঠানে জন্মগ্রহণ ও মৃত্যুবরণের ক্ষেত্রে উহার দায়িত্বপ্রাপ্ত মেডিক্যাল অফিসার অথবা ডাক্তার বা ক্ষমতাপ্রাপ্ত কোনো কর্মকর্তা;
(ছ)
কোনো গোরস্থান বা শ্মশান ঘাটের তত্ত্বাবধায়ক;
(জ)
নিবন্ধক কর্তৃক নিয়োজিত অন্য কোনো কর্মকর্তা বা কর্মচারী;
(ঝ)
জেলখানায় জন্ম ও মৃত্যুর ক্ষেত্রে জেল সুপার বা জেলার বা তত্কর্তৃক ক্ষমতাপ্রাপ্ত ব্যক্তি;
(ঞ)
পরিত্যক্ত শিশু বা সাধারণ স্থানে (Public Place) পড়িয়া থাকা পরিচয়হীন মৃত ব্যক্তির ক্ষেত্রে সংশ্লিষ্ট থানার ভারপ্রাপ্ত কর্মকর্তা; এবং
(ট)
নির্ধারিত অন্য কোনো ব্যক্তি বা প্রতিষ্ঠান ৷
(২) কোনো ব্যক্তির জন্ম ও মৃত্যু সংক্রান্ত তথ্য উপ-ধারা (১) এ উল্লেখিত ব্যক্তির নিকট সরবরাহ করিলে তিনি নিজে উহা নিবন্ধনের প্রয়োজনীয় ব্যবস্থা গ্রহণ করিবেন অথবা তথ্য প্রদানকারী ব্যক্তিকে নিবন্ধনের পরামর্শসহ প্রয়োজনীয় সহায়তা প্রদান করিবেন ৷
১০ ৷ শিশুর নাম নির্ধারণ - জন্ম নিবন্ধনের পূর্বে শিশুর নাম নির্ধারণ করিতে হইবে :
তবে শর্ত থাকে যে, কোনো শিশুর নাম নির্ধারণ করা না হইলে উক্ত শিশুর জন্ম নিবন্ধন করা যাইবে এবং সেইক্ষেত্রে নিবন্ধনের পরবর্তী ৪৫ (পঁয়তাল্লিশ) দিনের মধ্যে তাহার নাম সরবরাহ করিতে হইবে ৷
১১ ৷ জন্ম ও মৃত্যু সনদ প্রদান - কোনো ব্যক্তির আবেদনক্রমে নিবন্ধক নির্ধারিত ফি ও পদ্ধতিতে নিবন্ধিত ব্যক্তির জন্ম বা মৃত্যু সনদ প্রদান করিবেন ৷
১২ ৷ নিবন্ধন সংক্রান্ত তথ্য অনুসন্ধান - (১) কোনো ব্যক্তি নির্ধারিত ফি প্রদান সাপেক্ষে নিবন্ধন বহির যে কোনো তথ্যের বা উদ্বৃতাংশের জন্য নিবন্ধকের নিকট আবেদন করিতে পারিবেন :
তবে শর্ত থাকে যে, উপ ধারা (১) এর অধীন প্রদত্ত উদ্বৃতাংশে মৃত্যুর কারণ অন্তর্ভূক্ত করা যাইবে না ৷
(২) উপ-ধারা (১) এর অধীন প্রদত্ত সকল তথ্য ও উদ্বৃতাংশ নিবন্ধন কর্তৃক প্রত্যায়িত হইতে হইবে এবং উহা সাক্ষ্য হিসাবে গ্রহণযোগ্য হইবে ৷
১৩ ৷ বিলম্বিত নিবন্ধন ।- ধারা ৮ এ উল্লিখিত নির্দিষ্ট সময়ের মধ্যে জন্ম বা মৃত্যুর তথ্য নিবন্ধকের নিকট প্রেরণ করা না হইলে পরবর্তী সময় উহা নির্ধারিত সময়, পদ্ধতি ও ফি প্রদান সাপেক্ষে নিবন্ধন করা যাইবে :
তবে শর্ত থাকে যে, এই আইন কার্যকর হইবার পূর্বে জীবিত ও মৃত ব্যক্তির নিবন্ধনের ক্ষেত্রে এই আইন কার্যকর হইবার ২ (দুই) বত্সরের  মধ্যে ফি এর প্রয়োজন হইবে না ৷
অধ্যায়-৩
নিবন্ধন বহি সংরক্ষণ, সংশোধন ও পরিদর্শন
১৪ ৷ রেকর্ড সংরক্ষণ । - (১) নিবন্ধক নির্ধারিত পদ্ধতি ও ফরমে নিবন্ধন বহি সংরক্ষণ করিবেন এবং নিবন্ধন বহি স্থায়ী রেকর্ড হিসাবে গণ্য হইবে ৷
(২) নিবন্ধন বহি হারাইয়া গেলে বা বিনষ্ট হইলে নিবন্ধক উহার জন্য দায়ী থাকিবেন ৷
(৩) নিবন্ধন বহি ছাড়া জন্ম বা মৃত্যু সংক্রান্ত তথ্য নির্ধারিত পদ্ধতিতে সংরক্ষণ করা যাইবে ৷
১৫ ৷ নিবন্ধন বহি সংশোধন । - (১) নিবন্ধন বহিতে কোন ভুল তথ্য লিপিবদ্ধ হইয়া থাকিলে, উহা সংশোধনের জন্য নির্ধারিত ফিসহ আবেদন করা যাইবে ৷
(২) উপ-ধারা (১) এর অধীন আবেদন যথাযথ মনে করিলে নিবন্ধক নিবন্ধন বহি সংশোধন করিবেন এবং সংশোধিত স্থানে তারিখসহ স্বাক্ষর প্রদান করিবেন ৷
১৬ ৷ তত্ত্বাবধান ও পরিদর্শন ।- সরকার কর্তৃক এতদুদ্দেশ্যে ক্ষমতাপ্রাপ্ত কোনো ব্যক্তি নিবন্ধকের কার্যালয়, নিবন্ধন বহি ও নিবন্ধন সংক্রান্ত সকল কার্যক্রম তত্ত্বাবধান ও পরিদর্শন করিতে পারিবেন ৷
১৭ ৷ প্রতিবেদন ।- সরকার প্রয়োজনে, নিবন্ধকের নিকট হইতে যে কোনো সময় নিবন্ধন সংক্রান্ত তথ্য বা উহার প্রতিবেদন তলব করিতে পারিবে এবং নিবন্ধক উহা সরকারের নিকট সরবরাহ করিতে বাধ্য থাকিবেন ৷
অধ্যায়-৪
বিবিধ
১৮ ৷ জন্ম ও মৃত্যু সনদের সাক্ষ্য মূল্য - (১) কোনো ব্যক্তির বয়স জন্ম ও মৃত্যু বৃত্তান্ত প্রমাণের ক্ষেত্রে কোনো অফিস বা আদালতে বা স্কুল-কলেজে বা সরকারি ও বেসরকারি প্রতিষ্ঠানে এই আইনের অধীন প্রদত্ত জন্ম বা মৃত্যু সনদ সাক্ষ্য হিসাবে বিবেচ্য হইবে ৷
(২) নিবন্ধন সংক্রান্ত সকল নথিপত্র ও নিবন্ধন বহি The Evidence Act, 1872 (Act 1 of 1872) এর Public Document (সাধারণ দলিল) যেই অর্থে ব্যবহৃত হইয়াছে সেই অর্থে Public Document (সাধারণ দলিল) বলিয়া গণ্য হইবে ৷
(৩) অন্য কোন আইনে যাহা কিছুই থাকুক না কেন, নিম্নবর্ণিত বিষয়াদির ক্ষেত্রে বয়স প্রমাণের জন্য এই আইনের অধীন প্রদত্ত জন্ম সনদ ব্যবহার করিতে হইবে, যথাঃ-
(ক)
পাসপোর্ট ইস্যু;
(খ)
 বিবাহ নিবন্ধন;
(গ)
শিক্ষা প্রতিষ্ঠানে ভর্তি;
(ঘ)
সরকারি, বেসরকারি বা স্বায়ত্তশাসিত প্রতিষ্ঠানে নিয়োগ দান;
(ঙ)
ড্রাইভিং লাইসেন্স ইস্যু;
(চ)
ভোটার তালিকা প্রণয়ন;
(ছ)
 জমি রেজিস্ট্রেশন; এবং
(জ)
বিধি দ্বারা নির্ধারিত অন্য কোন ক্ষেত্রে ৷
(৪) উপ-ধারা (৩) এ যাহা কিছুই থাকুন না কেন, কোনো শিক্ষা প্রতিষ্ঠান জন্ম সনদ ব্যতীত ভর্তি করিতে পারিবে এবং সেই ক্ষেত্রে ভর্তির পরবর্তী ৪৫ (পঁয়তাল্লিশ) দিনের মধ্যে জন্ম সনদ উক্ত শিক্ষা প্রতিষ্ঠানে দাখিল করিতে হইবে ৷
(৫) এই আইন কার্যকর হইবার অব্যবহিত পূর্বে অন্য কোনো আইনের অধীন কোনো জন্ম ও মৃত্যুর সনদ উপ-ধারা (৩) এর উদ্দেশ্যে পূরণকল্পে ব্যবহার করা যাইবে ৷
১৯ ৷ জনসেবক ।- নিবন্ধক, the Penal Code (Act XLV of 1860) এর section 21 এ public servant (জনসেবক) অভিব্যক্তিটি যেই অর্থে ব্যবহৃত হইয়াছে সেই অর্থে  public servant (জনসেবক) বলিয়া গণ্য হইবে ৷
২০ ৷ আপীল - নিবন্ধকের কোনো আদেশের বিরুদ্ধে সংক্ষুব্ধ ব্যক্তি আদেশের ৩০ (ত্রিশ) দিনের মধ্যে নিম্নবর্ণিত কর্তৃপক্ষের নিকট আপীল করিতে পারিবেন, যথা :-
(ক)
 ইউনিয়ন পরিষদের চেয়ারম্যান অথবা ক্ষমতাপ্রাপ্ত ব্যক্তির আদেশের বিরুদ্ধে উপজেলা নির্বাহী অফিসার;
(খ)
পৌরসভার চেয়ারম্যান বা প্রশাসক বা ক্ষমতাপ্রাপ্ত কোনো কর্মকর্তা বা কমিশনারের আদেশের বিরুদ্ধে জেলা ম্যাজিস্ট্রেট;
(গ)
ক্যান্টনমেন্ট বোর্ডের প্রেসিডেন্ট অথবা তত্কর্তৃক ক্ষমতাপ্রাপ্ত কর্মকর্তার আদেশের বিরুদ্ধে জেলা ম্যাজিস্ট্রেট;
(ঘ)
সিটি কর্পোরেশনের মেয়র অথবা তত্কর্তৃক ক্ষমতাপ্রাপ্ত কর্মকর্তা বা কমিশনারের আদেশের বিরুদ্ধে জেলা ম্যাজিস্ট্রেট; এবং
(ঙ)
রাষ্ট্রদূত বা তত্কর্তৃক ক্ষমতাপ্রাপ্ত কর্মকর্তার আদেশের বিরুদ্ধে সচিব, স্থানীয় সরকার বিভাগ ৷
২১ ৷ দণ্ড - এই আইনের বিধান বা তদধীন প্রণীত বিধি লঙ্ঘনকারী নিবন্ধক বা কোনো ব্যক্তি অনধিক ৫০০.০০ (পাঁচশত) টাকা অর্থদন্ডে অথবা অনধিক দুই মাস বিনাশ্রম কারাদন্ডে অথবা উভয় দন্ডে দন্ডনীয় হইবেন ৷
২২ ৷ মামলা দায়ের - এই আইনের অধীন দায়িত্ব পালনে ব্যর্থতার জন্য সংক্ষুব্ধ ব্যক্তি অথবা নিবন্ধক ম্যাজিস্ট্রেট এর আদালতে মামলা দায়ের করিতে পারিবেন ৷
২৩ ৷ বিধি প্রণয়নের ক্ষমতা ।- এই আইনের উদ্দেশ্য পূরণকল্পে সরকার, সরকারি গেজেটে প্রজ্ঞাপন দ্বারা, বিধি প্রণয়ন করিতে পারিবে ৷
২৪ ৷ রহিতকরণ ও হেফাজত - (১) The Births and Deaths Registration Act, 1873 (Bengal Act IV of 1873)  এতদ্বারা রহিত করা হইল ৷
(২) The Births, Deaths and Marriages Registration Act, 1886(Bengal Act VI of 1886) এর জন্ম বা মৃত্যু নিবন্ধনের ক্ষেত্রে প্রযোজ্য বিধানাবলী এতদ্বারা রহিত করা হইল ৷
(৩) উপ-ধারা (১) ও (২) এর অধীন রহিতকরণ সত্ত্বেও, রহিত Act ও বিধানাবলির অধীন কৃত সকল কাজকর্ম বা গৃহীত ব্যবস্থা এই আইনের অধীন কৃত বা গৃহীত হইয়াছে বলিয়া গণ্য হইবে ৷
